By creating an account, purchasing a service or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Eligibility and Accounts
You must be at least 18 years old and able to form a binding contract to use the Services. You agree to provide accurate, current and complete information and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
The Services
ContourHost provides shared cPanel web hosting, domain registration, business email and related add-ons. Features, specifications and plan limits are described on our website and may be updated to improve the Services. Some features rely on third-party providers (for example, domain registries and email platforms), whose terms may also apply.
Fees, Billing and Renewals
- You agree to pay all fees for the plan you select, plus any applicable taxes.
- Services are billed in advance on a monthly or annual basis, as chosen at checkout.
- Unless you cancel before the renewal date, plans renew automatically at the then-current rate using your payment method on file.
- Domain registrations and renewals are subject to the pricing and policies of the relevant registry and are generally non-refundable once processed.
Refunds
Refunds are governed by our Refund Policy, which forms part of these Terms.
Acceptable Use
Your use of the Services must comply with our Acceptable Use Policy. Violations may result in suspension or termination.
Your Content and Responsibilities
You retain ownership of the content you host with us. You are solely responsible for your content, applications, and for ensuring you have the rights to use them. You must keep your software, themes and plugins updated and secure. You grant us the limited right to store and transmit your content as necessary to provide the Services.
Backups
While we may maintain server-level backups for our own disaster-recovery purposes, you are responsible for maintaining your own current backups of your data. ContourHost is not liable for any loss or corruption of data.
Service Availability
We strive to provide 99.9% network uptime. Occasional maintenance, updates or circumstances beyond our reasonable control may cause interruptions. Scheduled maintenance will be communicated where practical.
Suspension and Termination
We may suspend or terminate your account or Services if you breach these Terms or the Acceptable Use Policy, fail to pay fees when due, or if required to protect our network, other customers or third parties. You may cancel your Services at any time through the client portal. Upon termination, your right to use the Services ends and your data may be deleted after any applicable grace period.
Intellectual Property
The ContourHost name, logo, website and software are owned by ContourHost/Codifyed LLC and protected by law. These Terms do not grant you any right to use our trademarks without our prior written permission.
Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, error-free or completely secure.
Limitation of Liability
To the maximum extent permitted by law, ContourHost and Codifyed LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue or data. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services in the three (3) months preceding the claim.
Indemnification
You agree to indemnify and hold harmless ContourHost, Codifyed LLC and its officers, employees and partners from any claims, damages, liabilities and expenses arising from your use of the Services, your content, or your violation of these Terms or applicable law.
Governing Law
These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules. Any dispute will be subject to the exclusive jurisdiction of the courts located in Wyoming, unless otherwise required by applicable law.
Changes to These Terms
We may modify these Terms from time to time. We will update the "last updated" date and, where appropriate, notify you. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
